§ 62-17. Unauthorized person on premises of licensed retail sales car business and/or body shop business.

  • (a)

    It shall be unlawful for any unauthorized person to be on the premises of a licensed retail sales car business and/or licensed body shop business on any day between the hours of 11:00 p.m. and 7:00 a.m. if:

    (1)

    Such unauthorized person have previously been warned by written citation issued by a law enforcement officer that their presence on the premises violates the provisions of this section; and

    (2)

    The premises of the licensed retail sales car business and/or licensed body shop business is identified by at least one sign located at each entrance to the premises, and one sign located at the approximate midpoint of each boundary of the premises which does not have an entrance way. Each such sign shall contain the following information in easy-to-read printing:

    NOTICE

    In accordance with the "Code of Ordinances, City of Milledgeville, Georgia," it shall be unlawful for any unauthorized person to be on the premises of (name of business) between the hours of 11:00 p.m. and 7:00 a.m.

    Violators will be prosecuted and, upon conviction thereof, shall be punished by a fine:

    a.

    Not to exceed $200.00 for the first such offense;

    b.

    Not to exceed $400.00 for the second such offense; and

    c.

    Not to exceed $600.00 and/or six months imprisonment for the third or subsequent such offense.

    (b)

    The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    (1)

    Unauthorized person means any person who has not received express permission of the owner or an authorized agent of the owner to be on such premises during the times prohibited by this section.

    (2)

    Licensed retail car sales business means any business whose dominant activity is the retailing of new and/or used motorized vehicles to the general public, and who have a valid current business license issued by the city.

    (3)

    Licensed body shop business means any business whose dominant business activity is the repair and restoration of damaged and/or wrecked motorized vehicles who have a valid and current business license issued by the city.

    (c)

    A person who violates this section shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine:

    (1)

    Not to exceed $200.00 for the first such offense;

    (2)

    Not to exceed $400.00 for the second such offense; and

    (3)

    Not to exceed $600.00 and/or six months imprisonment for the third or subsequent such offense.
