§ 86-91. Residential permitted parking.

  • (a)

    Definitions. Whenever in this section the following words are used, they shall, unless the context requires otherwise, be deemed to have the following meanings:

    Controlled parking residential zones means a contiguous area containing streets or parts thereof upon which there may be designated restricted residential parking by the city.

    Guest means one who is a recipient of hospitality at the home of another.

    Resident means one who makes his home in a particular place with ownership.

    Residential parking permit means a permit issued hereunder for the privilege of parking on a street designated as a "controlled parking residential area."

    Residential permitted parking only means a special area for the restricted parking of residents and guests on a street designated as being within a controlled parking residential area.

    Tenant means one who pays rent to occupy property owned by another for a stated period of time.

    (b)

    Privileges and restrictions on residential permitted parking only.

    (1)

    Permit bestows privileges and restrictions on residential parking permits. The holder of a residential parking permit shall be permitted to stand or park a motor vehicle displaying the permit and operated by him or her in a designated residential controlled parking area. While a vehicle for which a residential parking permit has been issued is so parked, such a permit shall be prominently displayed in the bottom drivers side corner of the front windshield of the vehicle.

    (2)

    Where parking prohibited. A residential parking permit shall not authorize the holder thereof to stand or park a motor vehicle in such places where the stopping, standing or parking of a motor vehicle is prohibited or set aside for specific types of vehicles, nor exempt the holder from the observance of any traffic regulation within the controlled residential area.

    (3)

    Where parking permitted. A residential parking permit shall permit such residents/tenants to park in a designated street for such permit.

    (4)

    Use by persons other than permitted regulated. No person other than the permittee named thereon shall use the residential parking permit or display it on a vehicle operated or parked, and any such use or display by a person other than the permittee shall constitute a violation of this chapter by the permittee and by the person who so used or displayed such parking permit. Bona fide visitors of permittee shall be issued a guest permit with permission of the permittee.

    (5)

    False representation. It shall constitute a violation of this chapter for any person to falsely represent himself as eligible for a residential parking permit and to furnish any false information in an application in order to obtain a residential parking permit.

    (6)

    Revocation of permit. The city is authorized to revoke the residential parking permit for any permittee found to be in violation of this chapter and upon written notification thereof, the permittee shall surrender such to the city. Failure, when requested, to surrender a residential parking permit so revoked shall constitute a violation of this chapter.

    (7)

    Administrative regulations. The police department shall have the authority to develop and implement administrative regulations for the enforcement of this chapter.
