§ 86-90. Controlled vehicle parking in residential areas.

  • (a)

    Definitions. Whenever in this section the following words are used, they shall, unless the context requires otherwise, be deemed to have the following meanings:

    Controlled parking residential zones means a contiguous area containing streets or parts thereof upon which there may be designated restricted residential parking by the city.

    Guest means one who is a recipient of hospitality at the home of another.

    Resident means one who makes his home in a particular place with ownership.

    Tenant means one who pays rent to occupy property owned by another for a stated period of time.

    (b)

    Privileges and restrictions on controlled parking residential zones.

    (1)

    Where parking prohibited. A residential parking zone shall not authorize the resident, tenant or guest to stop, stand or park a motor vehicle in such places where the stopping, standing or parking of a motor vehicle is prohibited or set aside for specific types of vehicles, nor exempt the resident, tenant or guest from the observance of any traffic regulation within the controlled residential area.

    (2)

    Use of on-street parking; nonresidents. No person other than residents, tenants or authorized guests of the controlled parking residential area shall park on streets properly marked as a residential parking zone.

    (3)

    The following streets have been designated as controlled vehicle parking:

    a.

    Liberty Street from Greene Street to Franklin Street.

    b.

    Greene Street from Columbia Street to Tattnall Street (north side only).

    c.

    Greene Street from Clarke Street to Wilkinson Street (south side only).

    d.

    Jackson Street from Hancock Street to Greene Street.

    e.

    North Columbia Street from Montgomery Street to Hancock Street.

    f.

    North Clarke Street from Montgomery Street to Thomas Street.

    g.

    Washington Street from Wayne Street to Clarke Street.

    h.

    South Wilkinson Street from Greene Street to Franklin Street.

    i.

    North Jefferson Street from Hancock Street to Montgomery Street.

    (4)

    Any person violating this section shall be subject to a monetary fine not to exceed:

    a.

    Fifty dollars for the first such violation;

    b.

    One hundred dollars for the second such violation;

    c.

    One hundred fifty dollars for the third or any subsequent violation.

    (5)

    Administrative regulations. The police department shall have the authority to develop and implement administrative regulations for the enforcement of this chapter.
